1. Nature of the service

HYPERLUXE is a curated marketplace for rare and off-market ultra-luxury assets. Brokers, dealers, agents and direct representatives with direct access to the source may have their inventory published on HYPERLUXE. HYPERLUXE reviews the essential information before publication, then creates and publishes accepted listings in a controlled, semi-anonymous and search-indexable format. Interested buyers contact the responsible broker or representative directly.

HYPERLUXE is not a public classifieds website, not a brokerage and not a closing service. HYPERLUXE does not act as a dealer, agent, auctioneer or party to any transaction, does not hold, purchase or sell assets directly, does not qualify buyers on behalf of the broker, does not negotiate on behalf of any party, does not guarantee closing and does not handle escrow. HYPERLUXE does not replace the broker or the seller.

Use of the Services and submission of any form requires that you are:

• at least 18 years of age;
• acting in a personal or professional capacity with genuine intent;
• legally authorised to enter into binding commitments in your jurisdiction.

Access to the Services is granted at our sole discretion. Submitting a form, broker application or inquiry does not guarantee publication, forwarding or any introduction. HYPERLUXE reserves the right to decline or revoke access.

4. Broker submissions and listings

Brokers, dealers, agents and direct representatives may contact HYPERLUXE to have an asset reviewed for publication. By submitting an asset, you represent that you have a direct link to the source and the authority to present the asset. HYPERLUXE reviews submissions and, in its sole discretion, may accept, decline, edit, anonymise, delay or remove any listing.

Accepted listings are created and published by HYPERLUXE in a controlled, semi-anonymous format. Publication terms are provided privately after review of the broker profile, the direct source access and the inventory concerned. HYPERLUXE may withhold or protect sensitive information such as real photos, chassis or registration details, exact addresses, owner identity and private documents.

5. Buyer and representative inquiries

Interested buyers contact the responsible broker or representative directly, through the contact option provided on the listing, primarily via WhatsApp. HYPERLUXE does not qualify buyers on behalf of the broker and does not place itself between the buyer and the broker.

The receiving broker or representative deals with the buyer under its own responsibility and manages buyer qualification, confidential information, documentation, negotiation and the transaction. HYPERLUXE is not a party to any resulting discussion, negotiation or transaction.

6. Fees

Publication of a listing is a paid service. Fees are not displayed on the Site: applicable publication terms, fees, billing terms and taxes are communicated privately after review and are confirmed in writing before they apply. HYPERLUXE charges 0% commission on any sale.

7. Information accuracy

Asset information presented through the Services, including specifications, descriptions and imagery, is provided for reference and sourced from brokers, dealers, sellers or their representatives. HYPERLUXE does not independently verify all details and makes no warranties as to accuracy, completeness or fitness for any purpose.

Pricing, availability and condition remain subject to direct verification with the responsible broker or seller. Published information does not constitute an offer, valuation or representation of any kind.

8. Confidentiality

Information received through the Services, including asset details, pricing, seller or owner identity, private documents and negotiation context, is confidential. It may not be shared, reproduced, published or disclosed to any third party without the prior written consent of HYPERLUXE or the party entitled to it.

Breach of this obligation may result in immediate suspension or termination of access and may give rise to legal liability.

9. No transaction guarantee

HYPERLUXE reviews and publishes listings only. We do not guarantee that any listing, inquiry or introduction will result in a completed transaction. We are not responsible for the identity, solvency, conduct, representations or performance of any broker, dealer, agent, buyer, seller or representative, nor for the outcome of any negotiation or sale.

10. Acceptable use

When using the Services, you agree not to:

• submit false, misleading, fraudulent or unauthorised information, mandates or identities;
• present an asset over which you have no genuine source link or authority;
• attempt to bypass HYPERLUXE to contact a counterparty in breach of confidentiality or to avoid applicable fees;
• scrape, copy, resell or republish listings or content without authorisation;
• interfere with the security, integrity or operation of the Services.

11. Intellectual property

All content forming part of the Services, including text, design, layout, imagery and structure, is the property of HYPERLUXE, the MHNWI group or their content licensors. No content may be reproduced, distributed or used for commercial purposes without prior written authorisation.

12. Limitation of liability

To the maximum extent permitted by applicable law, HYPERLUXE and the MHNWI group shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use of the Services, including but not limited to loss of transaction, loss of profit or reputational harm.

To the maximum extent permitted by law, our total liability in any circumstances shall not exceed the total amount, if any, paid by you to HYPERLUXE in the 12 months preceding the event giving rise to the claim.

13. Third-party services

The Services rely on third-party providers, including hosting, analytics, form processing, communication and messaging tools. Your use of the Services may be subject to those providers' own terms and privacy notices. HYPERLUXE is not responsible for the practices of independent third-party providers, brokers, sellers, buyers or transaction parties.

14. Suspension and termination

HYPERLUXE may suspend, restrict or terminate access to the Services at any time, including where these Terms are breached, where a submission or inquiry appears false or unauthorised, or where required to protect the Services, users or third parties. Provisions that by their nature should survive termination, including confidentiality, intellectual property and limitation of liability, remain in effect.

15. Modifications

HYPERLUXE may modify these Terms at any time. When we make changes, we update the “Last updated” date above. Continued use of the Services after any modification constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Principality of Andorra, without regard to conflict-of-law rules. Any dispute arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Andorra, unless mandatory law provides otherwise.
